These Terms of Service ("Terms") govern your use of the Galito mobile application ("the App"), operated by an individual sole proprietor based in Washoe County, Nevada, United States ("we," "us"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

The App is intended for users age 13 and older. By using the App, you represent that you are at least 13 years old. If we learn that a user under 13 has created an account, we will delete it.

2. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at the contact below if you suspect unauthorized use of your account.

3. Subscriptions & Billing

Some features of the App may require a paid subscription, purchased through the Apple App Store or Google Play. Subscriptions:

Automatically renew until you cancel, at the price and interval disclosed at purchase.
Are billed and processed by Apple or Google, not by us directly — refunds, cancellations, and billing disputes are handled through the respective platform's policies.
Can be managed or cancelled any time through your Apple ID or Google Play account settings; cancelling stops future renewals but doesn't refund the current billing period unless required by law or platform policy.

4. Acceptable Use

You agree not to: use the App for any unlawful purpose; attempt to reverse-engineer, scrape, or interfere with the App or its infrastructure; abuse the AI tutor feature to generate harmful, abusive, or illegal content; or share your account with others in a way that circumvents subscription limits.

5. Content & Intellectual Property

The App, including its lessons, curriculum, mascot art, and other content, is owned by us or our licensors and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial learning purposes. You may not copy, redistribute, or create derivative works from the App's content without our permission.

6. AI Tutor Feature

The "Falar com o Galo" tutor is powered by a third-party AI model and is provided for language-practice purposes only. Its responses may occasionally be inaccurate or inappropriate; it is not a substitute for professional instruction, translation, or advice of any kind.

7. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the App will be uninterrupted, error-free, or that using it will result in any particular level of language proficiency.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the App is limited to the amount you paid us in the 12 months before the claim arose.

9. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if you violate these Terms or if we discontinue the App.

10. Changes to These Terms

We may update these Terms as the App evolves. We'll post changes on this page with an updated "Last updated" date, and will make reasonable efforts to notify you of material changes.

11. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you have under the laws of your country of residence.
